TERMS OF USE OF THE SERVICES OF THE BROKERAGE PORTAL OPERATED BY NERITI PLUS, S.R.O.

These Terms and Conditions of Use of electronic services provided by Neriti Plus, s.r.o., with registered office at Na strži 2102/61a, 140 00 Prague 4 , ID No.: 10901434, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 350360, e-mail info@neriti.cz, telephone number 608605324, (hereinafter referred to as “Neriti Plus”) regulate in accordance with the provisions of Section 1751 of Act No. 89/2012 Coll, Civil Code, as amended (hereinafter referred to as the “Civil Code“), the rights and obligations of users of the mediation portal operated by Neriti Plus, as well as other terms and conditions of contractual relations arising from the provision of services through the website operated by Neriti Plus at the Internet address: www.neriti.cz.

1. Introductory provisions
2. Neriti Plus is the operator of a website in the environment of which it carries out the following activities consisting in the provision of the following health services to users:

1. the operation of an on-line booking system, on the basis of which a contract can be concluded for the mediation of booking appointments with contracted health service providers
2. operating an on-line ordering system for comprehensive preventive examinations beyond the scope of health insurance, on the basis of which a contract can be concluded for arranging medical examinations with contracted health service providers.
3. Neriti Plus hereby declares and makes it indisputable that it is not a provider of health services within the meaning of Act No. 372/2011 Coll., on Health Services and Conditions of their Provision (Health Services Act), as amended.

1. Terms and conditions of the online reservation system

1. Services are provided through a web interface to facilitate the booking of appointments with health service providers (hereinafter referred to as “appointment booking“) based on the availability of capacity in health facilities operated by contracted health service providers.
2. The reservation of an appointment according to the needs and time preferences of the user depending on the capacity of health service providers is charged according to the current price list on the website, while the user is always informed about the price of the reservation before using the respective service.
3. If the user is interested in booking an appointment, he/she selects a specific health service provider and the selected date and time of the appointment in the booking calendar from the list of available specialisations and indicates his/her willingness to enter into a mediation contract by selecting the “Book” icon. In order to properly complete the appointment booking, the User shall fill in the booking form to the extent specified, i.e. provide the name and surname, telephone number and email address in accordance with the facts, as well as confirm their knowledge of and consent to the wording of these Terms and Conditions, as well as the information on the processing of personal data. The user confirms the duly completed order by selecting the “Proceed to payment” icon.
4. The appointment brokerage contract becomes effective upon payment of the price for booking the appointment with the selected health care provider. The appointment booking fee can be paid in cash by online payment using a credit card or internet banking. In case of payment by credit card or internet banking, the user will be automatically redirected to the gopay payment gateway.
5. Upon receipt of the full amount of the reservation price, Neriti Plus will then send an email to the User’s email address provided in the reservation form to confirm receipt of the order and to create a binding reservation for the date.
6. Cancellation of a binding reservation of a date by the user is possible no later than 48 hours before the date of the booked date, by sending a message to the email address: info@neriti.cz or by calling the phone number: 608605324.Neriti Plus will then refund the price paid for the reservation in full to the user’s bank account from which the payment for the reservation was made, within 10 days from the date of cancellation.
7. In the event of cancellation of a binding reservation of a date by the user less than 48 hours before the date of the booked date, the price for the reservation of the date is not refunded and is unilaterally credited in full to cover the cancellation fee for late cancellation of the reservation of the date corresponding to the compensation of the costs associated with securing and organizing the reservation of the date.
8. If for capacity or other operational reasons on the part of the health service provider the reservation of the appointment is cancelled, Neriti Plus undertakes to inform the user of this fact immediately in writing or by telephone and to offer the user the possibility of booking an alternative appointment. If no alternative appointment is agreed, Neriti Plus will refund the full amount of the booking fee paid to the user’s bank account from which the booking fee was paid within 10 days of the date of cancellation.

1. Terms and conditions of providing services for ordering comprehensive preventive examinations beyond the scope of health insurance

1. If the user is interested in arranging an order for a comprehensive preventive examination within the scope of the offered specialization (hereinafter referred to as “examination“), the user shall fill in the order form within the specified scope, i.e., provide his/her name and surname, telephone number and email address in accordance with the facts, as well as confirm his/her acquaintance with and consent to the wording of these Terms and Conditions, as well as the information on the processing of personal data. The user confirms the duly completed order by selecting the “Submit Order” icon.
2. The order form will be processed by authorized Neriti Plus staff after it has been sent in order to verify the free capacity of the contracted providers, and the user will be contacted within 3 days to arrange a date for the tour according to the user’s time preferences.
3. Upon confirmation of the user’s interest in the offered appointment, Neriti Plus will arrange a binding appointment with the relevant healthcare provider.
4. Cancellation of a binding order by the user is possible at least 48 hours before the date of the tour, by sending a message to the email address: info@neriti.cz or by calling the telephone number: 608605324. In the case of cancellation of a binding order by the user less than 48 hours before the date of the tour, the provider is entitled to demand a cancellation fee for late cancellation corresponding to the compensation of the costs associated with arranging and organizing the tour.
5. If for capacity or other operational reasons on the part of the health service provider the appointment is cancelled, Neriti Plus undertakes to immediately inform the user of this fact in writing or by telephone and to offer the user the possibility of booking an alternative appointment.

1. Other provisions

1. The User acknowledges that health services provided on the basis of a mediated booking/order, which are covered by public health insurance, will be billed by the health service provider to the User’s respective health insurer. In the case of the provision of services to users who are not covered by public health insurance or where the service provided is not covered by public health insurance or is only partially covered by public health insurance, the cost of the service provided, or the part of the service not covered by health insurance, will be reimbursed by the user in accordance with the current price list of the health service provider in question. The services of the on-line reservation/ordering system operated by Neriti Plus are not covered by the public health insurance system within the meaning of Act No. 48/1997 Coll., on public health insurance, as amended.
2. A contract for the provision of the above services may also be concluded for the benefit of a third party. In the case of the use of services provided by Neriti Plus within the framework of special employee or similar programmes, the cost of the use of the specified services shall be paid by the provider of the programme on the basis of the terms and conditions set by the latter.
3. Since Neriti Plus is not a party to the mediated contractual relationship between the user and the chosen health care provider, it is not liable for the performance of the obligations arising from the health care contract in accordance with § 2636 et seq. of the Civil Code, nor for any damages resulting from a breach of the health care provider’s obligations.

1. Final provisions

1. These Terms and Conditions shall come into force and effect on 1.7.2024.
2. Neriti Plus reserves the right to unilaterally amend or supplement these Terms and Conditions. Such unilateral amendment to the Terms and Conditions shall become valid and effective from the moment of its publication. This provision shall not affect any rights and obligations that have accrued during the effective period of the previous version of the Terms.
